1. License and Purpose of Use

1. The Image Data may be used free of charge for activities intended to promote, introduce, publicize, or raise awareness of tourism information regarding Otsu City and the surrounding area.
2. Within the scope of the above purpose, the Image Data may be used after editing (including cropping, color correction, etc.).

2. Copyright and Credit Line

1. All copyrights and other intellectual property rights in and to the Image Data belong to the Association and are protected under the Copyright Act and international laws relating to copyright.
2. When using the Image Data, in principle, please clearly indicate the credit line “Photo: Biwako Otsu Tourism Association.” However, this shall not apply where, due to the design or nature of a publication or the like, it is unavoidable to include such credit.

3. Prohibited Acts

Any act or use that falls under, or may fall under, any of the following items is prohibited.

1. Manufacturing, selling, or leasing products or services that use the Image Data itself as material (e.g., postcards or calendars for sale, image-provision services, redistribution as web materials, etc.).
2. Any act that obstructs or interferes with tourism measures of Otsu City and the surrounding area, or the implementation thereof.
3. Any act intended solely for religious purposes.
4. Any act contrary to public order and morals.
5. Any criminal act, or any act that leads to a criminal act.
6. Any act that infringes the copyright, property, privacy, reputation, or other rights of the Association or any third party.
7. Any act that defames or slanders a third party.
8. Any act constituting advance election campaigning, election campaigning, or any similar act, or any act that violates the Public Offices Election Act.
9. Any other fraudulent or misleading act, or any act that the Association deems inappropriate.

4. Application for Publication with Facilities

Where the subject of the Image Data is a shrine, temple, or other facility (hereinafter referred to as the “Relevant Facility”), the user shall, at the user’s own responsibility, apply to and confirm with the Relevant Facility in advance regarding publication in magazines or other media. The Association shall not be liable whatsoever for any trouble or disadvantage arising from failure to comply with this process.

5. Measures in the Event of a Breach

In the event of a breach of any provision of these Terms, the Association may, at any time, suspend the use of the Image Data. In addition, the Association may restrict subsequent use of the Image Data or refuse such use.

6. Disclaimer

1. The Association shall not be liable whatsoever for any trouble or damage (whether direct or indirect) arising from the use or download of the Image Data.
2. In addition to the facility application set forth in Article 4, where rights clearance is required with respect to the subject (including persons, items, places, etc.), such as portrait rights, trademark rights, patent rights, or usage rights, the user shall carry out all such procedures at the user’s own responsibility and expense. The Association shall not be liable whatsoever for any trouble arising from such rights.

7. Request for Donation of Published Material

The Association would appreciate it if you could mail one copy of any publication in which the Image Data is used to the address below, or, in the case of web media, report it by email.
